Description
Implement an antitrust compliance program across the Consumer sector in France together with and under the supervision of the Legal Director including:
o Training business people in the scope of the program
o Implementation of the appropriate tools
o Assessment of the compliance program and competition law audit
o Advice to business people
o Annual communication to the FCA
o Work with outside counsel when needed
Be the lead antritust lawyer for the Consumer Legal group in EMEA collaborating with other EMEA Consumer lawyers and advising on antitrust implications of business models, working with outside counsel and US law department on antitrust implications of possible acquisitions and divestitures and collaborating with the LDE Competition Law Group
Support the Pharmaceutical division of Consumer in France (OTC and medical devices) including:
o Implement and approve/review of commercial policies in close collaboration with commercial teams
o Draft, negotiate and approve various types of contracts (commercial ones, services, etc.)
o Handle pre litigation or litigation cases including:
- File analysis
- Recommendations
- Drafting, negotiation of settlements
- Follow up and coordination of files with teams and management
- Follow up and coordination with insurance and outside counsel if appropriate
o Coordinate and support locally acquisitions and divestitures in close collaboration with local multidisciplinary teams; the US law department, the LDE and outside counsel when needed. Support integration of acquisitions locally
o Work closely with management and commercial colleagues in assessing risk and provide pragmatic and clear advice to help decision making in a compliant environment
Train business colleagues according to their needs (advertising law, basics of contracts, etc.)
Work with external partners (outside counsels, insurers, experts, trade associations )
Qualifications
A successful candidate should have :
- A French law degree
- at least 8 years of legal experience either in a leading law firm or in-house law dept of an international company
- strong antitrust expertise and experience outside the merger & acquisition field
- Solid university grades and proficiency in English.
- Industry based knowledge considered to be an asset, but not an absolute requirement.
- Ability to work independently and proactively but keeping a team player approach with good awareness of when to reach out / interact with colleagues and key stakeholders. Proven interest in and ability to develop understanding of consumer business (products, procedures, business model and industry trends).
- Strong intellectual curiosity, focused on meaningful results, strategic thinking, ability to collaborate and team up. Demonstrated willingness to listen and learn and proven ability to respectfully explain proper decisions (even when this leads to tough business discussions).
- Leadership skills, self-awareness and adaptability and flexibility in a fast moving consumer goods (FMCG) environment.
- Ability to work with usual IT tools (outlook, word, internet, powerpoint)
